Heard Sri Indra Sen Singh, learned counsel for the petitioner and Ms. Manju Thakur, learned A.G.A. appearing for the State.
The present petition has been filed under Article 227 of the Constitution of India assailing the order dated 10.5.2019 which was subsequent to the order dated 4.5.2019 passed by the Child Welfare Committee, Fatehpur, by which victim has been sent to Nari Niketan.
Learned A.G.A. has raised a preliminary objection regarding maintainability of the present writ petition as it has been filed against the order passed by the Child Welfare Committee. Learned counsel for the petitioner could not waive out the preliminary objection raised by the learned A.G.A. regarding the maintainability of the writ petition.
In view of the same, the contention of learned A.G.A. found force. Accordingly, the present writ petition is dismissed on the ground of maintainability with liberty to file an appropriate petition before the appropriate forum.
