Heard learned counsel for the petitioners, learned AGA for the State and perused the record.
The present petition has been filed with the prayer to quash the F.I.R. dated 07.11.2019, in Case Crime No. 0222 of 2019, under sections 366 IPC, P.S. Chirgaon, District Jhansi.
It is contended that the petitioner nos. 1 and 2 both are major. They had performed their marriage on 05.11.2019 out of their own freewill. The allegations in the F.I.R. that the petitioner no. 2 had enticed away the petitioner no. 1 are false. The marriage certificate and high school certificate of the girl has been filed alongwith the writ petition.
Be that as it may, this court does not find any ground to give any opinion on the merits of the case of the petitioners. However, it is provided that the petitioners shall not be arrested till submission of the police report under section 173(2) Cr.P.C. They shall, however, cooperate in the investigation and shall not make any effort to influence any witness.
The writ petition is disposed of accordingly.
