JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) Issue notice to the respondents returnable on 9.7.2012.
We have heard Mr. S. H. Sanjanwala, learned Senior counsel assisted by Mr. Dilip L. Kanojiya appearing on behalf of the petitioners and Mr. P.S. Champaneri, learned Assistant Solicitor General appearing for respondents.
Learned Senior counsel for the petitioners has urged that for the last about nine months, there is no Presiding Officer in the Tribunal where the Appeal filed by the petitioners is pending. Hence, the appeal filed by the petitioners is not decided in absence of Presiding Officer in the Tribunal.
For the aforesaid reason, we find a strong prima facie case for grant of interim order in favour of the petitioner. Ad-interim relief in terms of paragraph 20 (b) of the writ petition is granted till the returnable date.
Learned Senior counsel has submitted that sufficient number of copy shall be provided to Mr. P.S. Champaneri, learned Assistant Solicitor General today itself.
Direct service is permitted today.
