Heard Sri Chandra Shekhar Sharma, learned counsel for the petitioners, learned Standing Counsel for the State-respondents and perused the record.
This writ petition, inter alia, has been filed for the following reliefs:
"i. Issue a writ, order or direction in the nature of mandamus commanding to the respondents not to make any construction over the abadi land i.e. (Araji no. 334 of Rakba 0.4130 hectare) of petitioners situated at village Nevada, Pargana Kolsala, Tehsil Pindra, District Varanasi.
ii) Issue any other order or direction in the nature of mandamus directing the respondent nos. 5 to 9 not to interfere in peaceful possession of the abadi land of petitioners."
Learned counsel for the petitioner contends that the private respondents are forcibly raising construction over the abadi land of the petitioner.
The dispute raised in this writ petition is purely of civil in nature. The petitioner may approach the civil court of competent jurisdiction. In writ proceedings, such dispute cannot be resolved.
The writ petition is, accordingly, dismissed.
