Heard learned counsel for the petitioner; learned Standing Counsel for the respondents 1 and 2 and perused the record.
The case of the petitioner is that he is an informant in a murder case which has been registered as Case Crime No.0145 of 2020 at police station Jaitpura, district Varanasi. Despite named first information report, no arrest has been effected and the petitioner is being threatened. He has accordingly prayed for an arms licence as well as a bodyguard for his safety and protection.
It is not the specific case of the petitioner that he is also an eye-witness of the incident. From the first information report also it is not clear that the petitioner himself is an eye-witness.
Under the circumstances, without expressing any opinion on the merits, we deem it appropriate to dispose off this petition by giving liberty to the petitioner to apply for arms licence. If already an application for arms licence has been submitted by the petitioner before the licensing authority concerned, the same shall be addressed and decided expeditiously, preferably within a period of four weeks from the date of filing a copy of this order before the licensing authority. In addition to above, it shall also be open to the petitioner to move an application before the District Magistrate concerned for security and protection. If any such application is filed with regard to providing security to the petitioner, the District Magistrate concerned shall call for report from the police station concerned and shall take a reasoned decision, preferably, within next three weeks.
