Heard learned counsel for the petitioner, learned Standing Counsel for respondents State and Sri Achal Singh, learned counsel appearing for Gaon Sabha.
It is contended by learned counsel for petitioner that an application was moved by petitioner on 22.01.2021 claiming that license of fair price shop be granted in her favour which was originally in the name of her husband who unfortunately died on 01.01.2021.
The claim made by petitioner is on the strength of Government Order dated 17.08.2002 read with Government Order dated 05.08.2019. The sole prayer is for early disposal of the application.
Learned Standing Counsel does not oppose the limited prayer so made for early disposal of the application.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no. 2 to decide the application of petitioner, if there are no legal impediments and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of three months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
