Heard learned counsel for the applicant and learned A.G.A. and perused the record.
Counsel for the applicant is permitted to correct the name of the applicant.
Learned counsel for the applicant submitted that in fact the father of the informant was working as carpenter at Dubai and applicant was supervisor at the same shop. The informant and his father were pressurise the applicant to give the favorable report so that he might continue in the job. Due to that reason, on the basis of false and concocted story, a First Information Report was lodged to the effect that the money was paid on assurance to provide the employment. No one has filed any complaint except the applicant. However, the applicant was apprehended and is in jail since 16.6.2008 in Case Crime No. 1037 of 2008, under Sections 419, 420, 467, 468, 471, 406, 504, 506 I.P.C., P.S. Kotwali, District Jaunpur.
In view of the aforesaid fact, without observation on merit, let the applicant Kailash Nagar be released on bail, in case crime no. 1037 of 2008, under Sections 419, 420, 467, 468, 471, 406, 504, 506 I.P.C., P.S. Kotwali, District Jaunpur, on his furnishing a personal bond and two heavy sureties each in the like amount to the satisfaction of the Court concerned.
