Heard Sri Brijesh Kumar Sharma, learned counsel for the applicant, Sri Sanjay Singh, learned AGA for the State and perused the material on record.
This is an application for modification in order dated 13.1.2021 passed by this Court by which the applicant has been granted bail subject to certain conditions in which there is a direction that amongst two sureties one should be of his family member.
Learned counsel for the applicant argued that the applicant is unable to file any surety of his family members as the applicant lives separately from his brother Ramesh and his father is also in jail. Paragraph 3 of the affidavit in support of the modification application has been placed before the Court. It is argued that as such in spite of the order dated 13.1.2021 the applicant could not be released from the jail.
After having heard learned counsel for the parties and perusing the record, the order dated 13.1.2021 passed by this Court in so far as it relates to the condition that one of the sureties will be the family member of the applicant is modified to the extent that one of the sureties in the matter will be close relative of the applicant.
The modification application is allowed to the above extent.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad.
The computer generated copy of such order shall be self attested by the counsel of the party concerned.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
