Heard learned counsel for the petitioner; learned AGA for respondents 1, 2 and 3; and perused the record.
The grievance of the petitioner is that against the order of externment an appeal is pending before the Commissioner, Jhansi Division, Jhansi but the stay application filed by the petitioner has not been addressed and only a date has been fixed in the appeal.
Considering the nature of the grievance, this petition is disposed off by providing that the second respondent (Commissioner, Jhansi Division, Jhansi) shall accord expeditious consideration to the stay application preferred by the petitioner preferably, within a period of two weeks from the date of furnishing certified copy of this order in his office. It is made clear that this order would not be operable if the stay application has already been rejected.
With the aforesaid direction, the petition stands disposed off.
