By way of the instant application, the applicant has prayed for a direction to the court below to decide Case No.2624 of 2016, under Sections 498A, 323 IPC and 3/4 D.P. Act, Police Station- Mughalsarai, District Chandauli, pending in the court of Chief Judicial Magistrate, Chandauli, expeditiously.
I have considered the submissions advanced by learned counsel for the applicant and perused the record.
Obviously, the court below is under obligation to expedite the proceeding adhering to the provision of Section 309 Cr.P.C. Therefore, no order need be passed by this Court.
Consequently, this application is disposed of.
