Petitioner is a retired employee of Nagar Nigam, Prayagraj. He has superannuated on 31.12.2018. It is stated that though pension has been sanctioned to petitioner but other retiral benefits have not been paid, so far.
Admittedly, entire retiral benefits which are due and payable to petitioner have not been released to him, although a period of about one year is about to expire.
In that view of the matter, this writ petition stands disposed of with a direction upon the respondent no.2 to ensure that all withheld retiral benefits due and payable to petitioner, are calculated and paid to him, within a period of two months from the date of presentation of certified copy of this order, failing which petitioner would be entitled to interest at the rate of 8% per annum. It shall be open for the respondents to determine guilt of person who is found responsible for not ensuring release of amount within the period specified and to recover it from his salary.
