Learned APP Mr. HL Jani waives service of rule for respondent NO.1-State.

The present petition has been filed by the petitioner under Art. 14 and 226 of the Constitution of India as well as under sec. 482 of the Code of Criminal Procedure.

Learned advocate Mr. Kinariwala seeks permission to withdraw this petition with a view to file appropriate application before the Court of Magistrate without prejudice to the rights and contentions.

Permission granted. The petition stands disposed of as withdrawn. Rule discharged.
