HON’BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.356 of 2014 ORDER:
It is stated in the counter affidavit filed on behalf of the respondent that Index II register is available in this office but the index particulars are not available in the Index II register. As per the office records the Vol.No.152 Book-I has been sent to the Presiding Officer, State Transport Tribunal, Hyderabad vide this office letter dated 06.09.1975. But the same was never returned to this office. He further states that he cannot issue a certified copy on the Xerox copy which was submitted by the petitioner without verifying the Vol.No.152.
In view of the above stand taken by the respondent, it cannot be said that the order passed by this Court is violated either willfully or wantonly warranting initiation of contempt proceedings.
Accordingly, the Contempt Case is closed. However, it is open for the petitioner to workout his remedies.
There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Contempt Case shall stand dismissed.
