Venkateswarlu … Petitioner And The Government of Andhra Pradesh Municipal Administration Rep. by its Principal Secretary Secretariat Hyderabad and others … Respondents THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.22838 OF 2008 ORDER: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition was filed alleging inaction of respondent Nos.1 and 2 in recovering the balance bid amount for the years 2001-2004 relating to tenders for collection of toll from vendors of daily market in Anantapur town, from respondent Nos.3 to 5.
We have very doubt about the bona fides of the writ petitioner. The grievance of the petitioner is that respondent Nos.3 to 5 have participated in the tender process for collecting toll from daily vendors in the market in Anantapur town. Even after respondent Nos.3 to 5 have become successful in the bid, they did not pay the balance bid amount and no action was taken to recover the same on one hand, and on the other hand they were allowed to collect the toll.
In the counter affidavit filed on behalf of respondent No.2 it is admitted that the balance amount could not be recovered from respondent Nos.3 to 5. In this regard, respondent No.2 has filed three suits against respondent Nos.3 to 5 in the jurisdictional civil court, which passed decrees in favour of respondent No.2. However, it has not been stated whether the decrees have been executed or not.
Therefore, going by the statement and averment in the counter affidavit, we direct respondent Nos.1 and 2 to take steps forthwith for execution of the money decrees, if they are not stayed or set aside by appropriate forum. This action must be taken peremptorily within a period of one month from the date of receipt of a copy of this order.
With the above directions, the writ petition is disposed of.
Pending miscellaneous petitions shall stand closed. There will be no order as to costs.
