JUDGMENT / ORDER

PRABHAKAR RAO COUNSEL FOR THE RESPONDENT: THE PUBLIC PROSECUTOR Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to release the petitioner on bail in the event of his arrest in Crime No.278 of 2013 on the file of Police Station Subedari, Warangal District.
The Court made the following Order:
“The petitioner is accused No.6 in Crime No.278 of 2013 of Subedari Police Station, Warangal District. He seeks for grant of anticipatory bail. He allegedly committed offences under Sections 417, 465, 466, 468, 471, 472 and 406 I.P.C. The offences are triable by a Magistrate of First Class. It would be appropriate in the ordinary circumstances for the petitioner to surrender before the trial Court and move the trial Court for grant of regular bail.
Heard the learned counsel for the petitioner. Learned Public Prosecutor opposed for grant of bail.
However, I find that this Court in similar circumstances in Crl.P.No.15266 of 2013 granted anticipatory bail. Apart from this, the petitioner described himself as a Government Servant and his arrest and detention for more than 48 hours may lead to suspension from service. Therefore, I consider it appropriate to enlarge the petitioner on bail.
Accordingly, this Criminal Petition is allowed. The petitioner shall surrender before the learned IV Additional Judicial First Class Magistrate, Warangal, within two weeks from today. On such surrender, the learned IV Additional Judicial First Class Magistrate, Warangal, shall enlarge the petitioner on bail on his executing a personal bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties in a like sum each to his satisfaction.”
