FOR R2) … PETITIONERS … RESPONDENTS THESE WRIT PETITIONS ARE FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE RESPONDENTS TO CONSIDER THE REPRESENTATIONS OF THE PETITIONERS DTD:15.3.2018, 13.3.2018 AND 12.3.2018 AT ANNEXURE-F1 TO F7 SERIES ALLOT THE AVAILABLE VACANT SITES IN DASARAHALLI AND KETHAMARANAHALLI LAYOUT.
THESE PETITIONS COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Mr.Ajit Kalyan, learned counsel for the petitioner. Mr.Y.D.Harsha, learned Additional Government Advocate for respondent No.1 Mr.Sharath B.Belavigi, learned counsel for respondent No.2.
2. The writ petitions are admitted for hearing.
With consent of the parties, the same are heard finally.
3. In these petitions the petitioner inter alia seeks a direction to the respondents to consider the representations dated 15.03.2018, 13.03.2018 and 12.03.2018 at Annexures F1 to F7 to allot the available vacant sites in Dasarahalli and Kethamaranahalli Layout.
4. When the matters were taken up today, learned counsel for the petitioners submitted that the petitions be disposed of with a direction to the Commissioner, Karnataka Housing Board, Bengaluru to consider and decide the representation submitted by the petitioners by a speaking order within a fixed time limit. On the other hand, learned counsel for the respondents submitted that suitable action on the representation shall be taken.
5. In view of the aforesaid submissions and in the facts of the case, the Writ Petitions are disposed of with a direction to the Commissioner, Karnataka Housing Board, Bangalore to consider the representation submitted by the petitioners by a speaking order within a period of one week from the date of receipt of the certified copy of the order passed today. It is made clear that this Court has not expressed any opinion of the merits of the claim of the petitioners.
Accordingly, the petitions are disposed of.
