JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) FRIDAY, THE TWENTY SIXTH DAY OF SEPTEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.29435 of 2014 BETWEEN K.V.Pratap AND ... PETITIONER The Government of Andhra Pradesh, rep. by its Principal Secretary, Revenue Department, Secretariat Buildings, Hyderabad and others ...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioner’s grievance in this writ petition is limited only to the extent of respondent No.2 not considering his revision petition filed on 07.03.2014 along with an application for interim relief. It is stated that the said revision petition filed under Section 9 of the A.P. Rights in Land and Pattadar Passbooks Act, 1971, is directed against the orders of the Revenue Divisional Officer (RDO), Manchherial in Appeal Case No.G/2285/2005, dated 07.02.2014. The order under revision was passed by the RDO directing cancellation of entries in the revenue record in the name of the petitioner herein. Hence, the petitioner sought interim relief in the said revision. Since no date is fixed in the said revision nor any orders are passed in the said interim application, the present writ petition is filed alleging inaction.
3. Learned Government Pleader, on instructions, states that the Joint Collector will take appropriate steps by fixing the date in the said revision.
4. In the facts and circumstances of the case, the writ petition is disposed of directing respondent No.2- Joint Collector to fix a date for hearing of the said revision petition and the interim application thereon and pass appropriate orders at least to the extent of interim application within four weeks from the date of receipt of a copy of this order. Till the order, as directed above, is passed by respondent No.2, the entries in the revenue record, as existing as on today, shall be maintained and thereafter the entries in the record shall be subject to orders that would be passed by respondent No.2, as directed above.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
