Petitioner is an agent of respondent insurance company. On 28.3.2011 the agency of the petitioner was suspended on the allegation that the insurance company received complaints from policy holders that loans were raised on their policies. On 14.11.2011 petitioner was called upon to file an explanation and he has submitted his explanation on 23.11.2011. On 14.3.2012 second respondent informed the petitioner that corporation intend to impose penalty of termination of agency with forfeiture of renewal commission and to recover a sum of Rs.3,58,140/- and called upon the petitioner to submit his explanation. On 20.3.2012 petitioner filed his explanation which was acknowledged by the respondents. Grievance of the petitioner necessitating to institute this writ petition is that so far no further orders are passed and on account of suspension of agency petitioner is unable to eke-out his living as agency was his primary source of living.
Though sufficient time is granted, no information is furnished on behalf of the respondent corporation regarding status of the issue pursuant to issuance of show cause notice dated 14.3.2011.
Having regard to the submissions made, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the second respondent to consider the explanation submitted by the petitioner dated 20.3.2012 and pass orders on the issue which is subject matter of show cause notice dated 14.3.2012 within a period of three weeks and communicate the decision to the petitioner.
Accordingly, writ petition is disposed of. No costs. Sequel to the same, miscellaneous petitions, if any stand disposed of.
