This petition under section 24 of the Code of Civil Procedure is filed by the petitioner seeking transfer of M.O.P.No.168 of 2011 from the file of Motor Accident Claims Tribunal-cum-District Judge, Vizianagaram, to Motor Accident Claims Tribunal, Visakhapatnam.
Heard.
Petitioner seeks transfer of the case on the ground that as on the date of accident, he was residing at Vizianagaram. As such, he filed O.P. at Vizianagaram. But, due to accident, he suffered disability and still he is taking treatment at Visakhapatnam. As such, he shifted his residence from Vizianagaram to Visakhapatnam and it is becoming difficult for him to attend the Court at Visakhapatnam to prosecute the O.P. filed by him for compensation.
Considering the above circumstances and in the interest of justice, it is just and necessary to transfer the case as prayed by the petitioner.
Hence, this petition is allowed and M.O.P.No.168 of 2011 is hereby withdrawn from the file of Motor Accident Claims Tribunal-cum-District Judge, Vizianagaram, and transferred to Motor Accident Claims Tribunal, Visakhapatnam, for disposal in accordance with law.
Miscellaneous petitions pending in this petition, if any, shall stand closed.
