JUDGMENT / ORDER

. Respondent/Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the Station House Officer, II Town Police Station, Tirumala, Chittoor District, to release the petitioners on bail in the event of their arrest in connection with Cr.No.63/2011 of II Town Police Station, Tirumala, Chittoor District, in the interest of justice.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri T. Pradyumna Kumar Reddy, Advocate for the Petitioner and of the Public Prosecutor, for the Respondent, the Court made the following.
ORDER:
“The petitioner seeks for grant of anticipatory bail. He is the sole accused. He allegedly committed the offences under Sections 420, 468 and 471 IPC. He is said to be working as a Constable in the Andhra Pradesh Special Protection Force at Tirumala.
2. The learned counsel for the petitioner submitted that the charge-sheet had already been filed.
3. The petitioner would appear to have filed a petition under Section 482 Cr.P.C earlier seeking for the quashment of the case against him. The petition was rejected with a direction to the Police to complete the investigation without making the arrest of the petitioner. The investigation however concluded and the charge-sheet had been filed exposing the petitioner to arrest. In view of the nature of the offences levelled against the petitioner and also in view of his calling, I consider it appropriate to enlarge the petitioner on anticipatory bail.
4. Consequently, this petition is allowed. The petitioner/accused shall surrender before the II Additional Judicial Magistrate of First Class, Tirupati, Chittoor District within 2 (two) weeks from today.
On such surrender, the learned II Additional Judicial Magistrate of First Class, Tirupati shall release the petitioner/accused on bail on a bond of Rs.10,000/- (Rupees ten thousand only) with two sureties in a like sum to his satisfaction.”
