Heard Sri Ajay Kumar, learned Standing Counsel appearing for the respondent.
Present appeal is directed against the judgment and award dated 17.1.1991 passed by the III Additional District Judge, Jaunpur in L.A.R. No. 107 of 1990.
At the very outset learned counsel appearing for the respondent submits that against the same judgment passed by the Reference Court in L.A.R. No. 107 of 1990 one appeal was filed by Vijay Nath being First Appeal No. 195 of 1991, Vijay Nath Vs. Collector and the present appeal was filed by the Krishi Utpadan Mandi Samiti challenging the same judgment. He submits that the appeal filed by Vijay Nath was allowed and after quashing the impugned judgment dated 17.1.1991 passed in same Land Acquisition Reference No. 170 of 1990 the matter was remitted back to the Reference Court. He submits that in view of the aforesaid, present appeal has become infructuous.
Apart from the above, I have noticed that the valuation of the appeal is Rs. 30,000/- only.
In such view of the matter, present appeal stands dismissed as having become infructuous.
