Srikanth and another … Respondents THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE NO.201 OF 2014 ORDER: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) There is no allegation of wilful violation of the order of this Court dt.24.6.2013 and nothing is mentioned whether the order of this court has been violated wilfully or not. The allegation of wilful disobedience is the sine qua non to maintain the contempt case.
We, therefore, dismiss this contempt case. However, liberty is given to file a fresh one in accordance with law.
