This contempt petition has been filed against the non-compliance of the order and direction issued by this Court in W.M.P.No.150 of 2016 in W.P.No.261 of 2016, dated 06.01.2016.
2. It is represented by the learned counsel for the petitioner and the learned counsel for the respondents 1 and 3 that the order passed by this Court in W.M.P.No.150 of 2016 in W.P.No.261 of 2016, dated 06.01.2016 was modifed by this Court on 14.12.2016. This Court has passed the following order:-
"Learned counsel for the private respondent / sixth respondent has drawn the attention of this Court to the Additional Affidavit dated 27.11.2016 and would submit that the interim order came to be passed on 06.01.2016 and whereas, the sixth respondent was given appointment as Physical Directoress in the fourth respondent / School on 04.01.2016 itself and accordingly, she joined duty on 07.01.2016 at 09.45 a.m., before the communication of the interim order and would further add that though the sixth respondent was working in that capacity, she is yet to be paid with salary.
2. In the light of the fact that the sixth respondent has already joined duty and the salary due and payable to her is to be paid, the interim injunction granted by this Court on 06.01.2016, is modifed with regard to payment of salary alone and it is also made clear that it is subject to the result of the writ petition and the sixth respondent cannot calim any equity on the basis of this interim order at the time of the final disposal of the writ petition."
3. Considering the above fact and recording the submission of the learned counsel for the petitioner and the learned counsel for the respondetns 1 and 3, the Contempt Petition is closed.
