K.P.Yashodha, HCGP for R1) …Petitioners …Respondents This Criminal Petition is filed under Section 482 Cr.P.C. praying to quash the entire proceedings in C.C.No.84/2016 for the offence punishable under Section 506, 504, 143, 147, 148, 323 and 324 read with 149 of IPC on the file of Civil Judge and JMFC., Harapanahalli.
This Criminal Petition coming on for admission this day, the court made the following:
ORDER The petitioners have prayed for the following relief:
i. Quash the entire proceedings in C.C.No.84/2016 (Old C.C.No.
1405/2012) for the offences punishable under Sections 143, 147, 148, 232, 234, 504, 506 r/w Section 149 of IPC pending on the file of the Civil Judge and JMFC, Harapanahalli.
ii. Call for the relevant records of the C.C.No.84/2016 (Old C.C.No.
1405/2012) on the file of the Civil Judge and JMFC, Harapanahalli 2. The serious allegations alleged against the petitioners are in respect of offences under Sections 143, 147, 148, 232, 234, 504, 506 r/w Section 149 of IPC.
Specific date and time has been stated in the complaint. Perusal of the allegations stated in the complaint prima facie indicate that the aforesaid offences are attracted. The petitioners have not made out a case to interfere with the proceedings in C.C.No.84/2016 (Old C.C.No.1405/2012). Accordingly petition is dismissed.
