For Petitioner : Mr.C.Prakasam ORDER This Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate No.I, Namakkal, Namakkal District to conclude the trial in CC No.122 of 2013 within the stipulated time as fixed by this Hon'ble Court.
2. The case of the petitioner is that he has lodged a private complaint against the respondent herein for the offence punishable under Section 138 of the Negotiable Instruments Act and the same was taken on file as CC No.122 of 2013 on the file of the learned Judicial Magistrate No.I, Namakkal. After several adjournments, PW.1 was cross examined on 06.01.2017. However, the trial is yet to be completed. Hence, the petitioner is before this Court for speedy trial.
3. Heard the learned counsel for the petitioner and perused the documents filed before this Court.
4. Considering the facts and circumstances of the case and also taking note of the fact that the case is pending from 2013, this Court directs the learned Judicial Magistrate No.I, Namakkal to conclude the trial in CC No.122 of 2013 and dispose of the same, on merits and in accordance with law, as expeditiously as possible, preferably, within a period of eight weeks from the date of receipt of a copy of this order.
5. Accordingly, the Criminal Original Petition is ordered.
