Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the first respondent to transfer the petitioner's complaint in Crime No.399 of 2007 pending on the file of the second respondent police to any other independent investigating agency for proper investigation.

Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that due to flood in November, 2015, the entire files relating to Crime No.399 of 2007 got submerged into the water and hence, the respondent police is not in a position to conduct enquiry relating to Crime No.399 of 2007. Now, he has fairly submitted that he is having a copy of the complaint, which shall be placed before the respondent police for appropriate action.
3. In view of the said submission made by the learned Additional Public Prosecutor, the respondent police is directed to conduct enquiry on receipt of the copy of the complaint furnished by the learned Additional Public Prosecutor and complete the same and file final report as expeditiously as possible, preferably, within a period of four weeks from the date of receipt of a copy of this order. The criminal original petition is disposed of accordingly.
