HON’BLE Dr. JUSTICE K.G.SHANKAR Criminal Petition No.6629 of 2014 Order:
The petitioner allegedly committed offences under Sections 447 and 427 IPC as well as under Sections 3, 4 and 5 of the Andhra Pradesh Land Grabbing (Prohibition) Act, 1982 (the Act, for short).
2. The learned counsel for the petitioner contended that the offences are triable by a Special Court constituted under the Act but not by a general Criminal Court. He consequently seeks for quashment of C.C.No.494 of 2014 on the file of the III Metropolitan Magistrate, Cyberabad, Ranga Reddy District at L.B.Nagar.
3. I consider that it would be appropriate for the petitioner to move the Trial Court seeking for discharge on the ground that the Trial Court has no jurisdiction to entertain the case. Consequently, this petition deserves to be closed.
4. Where the petitioner is said to be 75 years old, I deem it appropriate to exempt the petitioner-accused from appearing before the Trial Court for a period of 4 (four) weeks from the date of receipt of a copy of this order by the Trial Court. This criminal petition is disposed of granting liberty to the petitioner-accused to move the Trial Court for discharge. The miscellaneous petitions, if any, pending in this petition shall stand closed.
