JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) THURSDAY, THE TWENTY SEVENTH DAY OF NOVEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.29301 of 2014 BETWEEN K.Srinivasa Rao AND .. PETITIONERS The Government of Andhra Pradesh, rep. by its Secretary and others ...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. This writ petition is filed alleging that respondent No.3 is not investigating Crime No.26 of 2014 though the said crime was registered as early as on 10.05.2014.
3. Learned Government Pleader has received instructions which state that after registration of the said crime, investigation was taken up and as the injured persons were admitted to various hospitals and they were released without information to the police, their statements could not be recorded and the wound certificates could not be obtained earlier. It is also stated that another case in crime No.25 of 2014 was also registered against the petitioner at the instance of one Koya Satish and six others. It is stated that the medial evidence shows that no such serious injury is caused. Thus, the police have completed investigation after examining the independent witnesses and are seeking appropriate permission from the Sub-Divisional Police Officer to refer the case as false. It is stated in the instructions that final report is being filed on 26.11.2014 before the concerned Magistrate.
4. Since the investigation is already completed and it is at the stage of filing of final report, the grievance of the petitioner that there is no investigation in the crime is apparently not correct. Since respondent No.3 is stated to have completed the investigation, let a copy of the final report be served on the petitioner so that petitioner may make his appropriate submissions before the learned Magistrate as and when the final report is considered by the learned Magistrate.
Writ petition is, accordingly, disposed of. As a sequel, miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
