JUDGMENT / ORDER

. Respondent/Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge of the petitioner on said in the event of their arrest in connection with Crime No.1261/2013 of P.S. L.B.Nagar.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri Srinivasa Rao Madiraju, Advocate for the Petitioners and of the Public Prosecutor for the Respondent, the Court made the following.
ORDER:
“The petitioners seek for grant of anticipatory bail. They are accused 1 and 2. They allegedly committed the offences under Sections 420, 506 and 109 IPC. The offences are triable by a Judicial Magistrate of First Class. It would be appropriate for the petitioners to surrender before the Trial Court and to move the Trial Court for grant of regular bail.
2. However, the 2nd petitioner, who is accused No.2, is a lady. In view of her sex, I consider it appropriate enlarge the 2nd petitioner on anticipatory bail.
3. Hence, this petition is allowed so far as the 2nd petitioner/accused No.2 is concerned. The 2nd petitioner/accused No.2 shall surrender before the II Metropolitan Magistrate, L.B.Nagar, Cyberabad within 2 (two) weeks from today. On such surrender, the learned II Metropolitan Magistrate, L.B.Nagar, Cyberabad shall release her on bail on a bond of Rs.10,000/- (Rupees ten thousand only) with two sureties in a like sum to his satisfaction.
4. So far as the 1st petitioner/accused No.1 is concerned, this petition is disposed of granting liberty to him to surrender before the Trial Court and to move the Trial Court for grant of regular bail. In such an event, uninfluenced by any part of this order, the learned Trial Judge shall dispose of such an application on merits on the same day on which it is filed.
5. Accordingly, this petition is allowed in part.”
