Heard learned counsel for the petitioner and learned Assistant Government Pleader for the respondents.
2. This writ petition was filed challenging the action of respondents 1 and 3 in cancelling the driving licence of the petitioner after 21 years of issue vide Memo No.3017/A5/2010 dated 29.07.2010 on the ground that he applied for the licence initially even before completion of 18 years. The said fact came to light at the time of verification of genuineness of the licence when the petitioner applied for the post of Assistant Motor Vehicle Inspector.
3. An identical case was considered by this Court in W.P. No.21237 of 2010 and by order dated 22.12.2010 held that the respondents having renewed the licence of the petitioner on several occasions, now cannot take a stand that the driving licence was wrongly issued to the petitioner initially. The writ appeal, W.A. No.424 of 2012, was also dismissed on 03.08.2012.
4. In view of the same, the impugned order in Memo No.3017/A5/2010 dated 29.07.2010 is set aside and this writ petition is allowed. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
