IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 16009 of 2014 Date: 12.06.2014 Between:
K. Sivaiah … Petitioner And The State of A.P., rep., by its Principal Secretary, Home Department, Hyderabad & others.
… Respondents This Court made the following:
THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 16009 of 2014 ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed seeking writ of Habeas Corpus on the admitted allegation that the petitioner’s wife has been allegedly detained by her parents.
Admittedly, the petitioner’s wife is an adult and matured. It is admitted that she is not an idiot nor insane, as such, it would be possible that she may not be willing to come back to the petitioner. In any view of the matter, it is not the case of unauthorized detention by the police.
Hence, the writ petition is dismissed. It would be open for the petitioner to approach the appropriate forum for redressal of his grievance.
Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed. No order as to costs.
