Order:
This Writ Petition is filed by the fair price shop dealer of Rudravaram Village of Atchampet Mandal feeling aggrieved by the action of respondent No.3 in not allotting the stocks of essential commodities for the month of September, 2014, to his fair price shop bearing No.44, Rudravaram Village, Atchampet Mandal, Guntur District.
At the hearing, the learned Assistant Government Pleader for Civil Supplies (AP), on instructions, submitted that the petitioner, who is, allegedly, residing in Hyderabad leaving the aforesaid fair price shop in the hands of his father for being run, has not produced the Demand Draft for the month of September, 2014, and that therefore, the stocks were not allotted to his fair price shop. He has further submitted that the learned Government Pleader has left strict instructions with respondent Nos.2 and 3 to act strictly in accordance with law and not to give rise to complaints of this nature.
The learned Counsel for the petitioner, while denying the allegation that his client is residing in Hyderabad, submitted that his client was prompt in producing the Demand Drafts in the past and that he will continue to be prompt in future also.
In the light of the above submission of the learned Counsel for the parties, this Writ Petition is disposed of with the direction to respondent Nos.2 and 3 to allot the stocks of essential commodities to the petitioner’s fair price shop referred to above, and allow him to function as the fair price shop dealer so long as his authorization remains in force subject to his producing Demand Drafts before the prescribed dates in future.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel, WPMP.No.42024 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
