HON’BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22972 of 2008 DATE: 18.06.2014 Between:
K. Satyanarayana … Petitioner And The District Collector, Anantapur Anantapur District & others … Respondents The Court made the following:
HON’BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22972 of 2008 ORDER:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents.
2. This writ petition was filed by the petitioner stating that he is having agricultural lands about 10 KM away from Anantapur town and he applied for gun licence in the year 1992 and the licence was accordingly issued on 10.11.1992. He purchased SBBL bearing No.BE 4647/1952. While so, in the year 1994 on the instructions of the State Government, he surrendered weapon before the 3rd respondent on 23.07.1994. Thereafter he submitted number of representations to the 2nd respondent for return of the weapon and when there was no action, he filed WP No.24724 of 1999 before this Court. This Court after hearing both sides directed the 2nd respondent to consider the petitioner’s representation for the release of the weapon and pass appropriate orders. Thereafter, the respondents released the weapon. Again, on the instructions of the State Government before the elections, he deposited the weapon before the 3rd respondent on 03.04.2004. After completion of the elections, he made representation to the respondents for release of the weapon and also for renewal of licence of the gun on 01.12.2005, but the 1st respondent passed orders on 02.09.2008 renewing licence, but did not release the weapon. He did not indicate any reasons in the order. Immediately, he filed a representation on 11.09.2008 before the 1st respondent. When the said representation was not disposed of, the present writ petition was filed.
3. This Court by order dated 24.12.2008 observed that the licence was renewed up to 30.11.2009 and in spite of the renewal of the licence, the weapon was not released in favour of the petitioner and as the petitioner, being licensee, is entitled for the release of the weapon. Accordingly, the respondents were directed to consider the release of the weapon forthwith.
4. Pursuant to the said direction, learned counsel for the petitioner states that the weapon was released in favour of the petitioner. In view of the same, no further orders are necessary.
5. The writ petition is accordingly closed. Pending miscellaneous petitions in this writ petition, if any, shall stand closed in consequence. No order as to costs.
