JUDGMENT / ORDER

ORDER:
This contempt case is filed alleging wilful disobedience of order dated 26.12.2012 in W.P.No.9327 of 2011.
A perusal of the above-mentioned order shows that this Court was not satisfied with the legality of the order passed by respondent No.1 in directing payment of compensation to the petitioner. However, while taking note of the undertaking given by respondent No.3 in the counter-affidavit that action is being taken for payment of compensation to the petitioner at Rs.5.00 lakhs and development charges at Rs.1.00 lakh per acre, apart from sanctioning of three house plots, the writ petition was disposed of without further adjudication. The said order has not declared the right of the petitioner for payment of compensation or development charges or sanctioning of three house plots.
The learned Government Pleader for Revenue (T.S.) has submitted that the said statement was made by respondent No.3 in the counter-affidavit as a mistake of fact.
In the absence of any relief granted by this Court in W.P.No.9327 of 2011, the contempt case is not maintainable.
Therefore, the contempt case is dismissed.
