JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) THURSDAY, THE SEVENTH DAY OF AUGUST TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 21436 of 2014 BETWEEN K.Sandhya Rani AND ... PETITIONER The State of Andhra Pradesh, Rep. by its Principal Secretary (Department of Revenue), A.P. Secretariat Building, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioner states that she has filed a complaint against respondent No.4 on 25.07.2014 and alleging that no action is taken on the said complaint, the present writ petition is filed on 28.07.2014. On the face of it, the writ petition appears thoroughly premature. However, since the grievance of the petitioner was with respect to the alleged kidnapping of her two year old daughter, this court required the government pleader to get instructions.
3. Learned Government Pleader, on instructions, submits that on the basis of the said complaint, Crime No.95 of 2014, has been registered on 25.07.2014 against four accused named therein and the Sub-Inspector of Police, who was entrusted with the investigation, has so far examined five witnesses and the further investigation is pending. It is assured that the investigation will be completed in an impartial and sincere manner as early as possible and appropriate action will be taken.
4. Learned counsel for the petitioner also submits that the petitioner is more concerned with the safety of the minor girl, who is only 2½ years old, and, as such, seeks the direction that she may be handed over to the petitioner. However, with regard to the custody of the said minor girl, petitioner has to invoke appropriate competent court.
The writ petition is, therefore, disposed of directing respondent No.3, Station House Officer to ensure early completion of investigation and take further appropriate necessary steps in accordance with law. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
