HON’BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.23081 of 1999 This writ petition is filed under Article 226 of the Constitution of India for the following reliefs:
"To issue an order direction or writ particularly one in the nature of writ of “Mandamus” (1) declaring the action of the respondent company in not considering the seniority- cum-fitness as criteria for regularization of the Acting Clerks in terms of Settlement dated 31-7-1997 is illegal and arbitrary; (2) declaring the proceedings No.P(PM)4/3208/2506 dated 22-10-1999 regularising the junior Acting Clerk to the petitioners ignoring the claim of the petitioners is illegal and arbitrary and consequently direct the respondents 1 to 6 herein to regularize the services of the petitioners in preference to the junior Acting Clerks with all consequential benefits in terms of the Settlement dated 31-7-1999 and grant such other relief or reliefs."
When the matter is called, the learned Standing Counsel for the respondent-organisation has placed on record a judgment of this Court in W.P.No.9428 of 2000 and batch dated 07.08.2000, wherein this Court dealt with identical issue and dismissed the writ petitions.
On the other hand, a circular in Ref.No.CRP/PER/R/01/02/61 dated 07.10.2014 is placed on record by the learned counsel for the petitioners and submits that there are a number of posts available now in the respondent-organisation.
In view of the above reasons and following the above referred judgment and for the reasons recorded therein, this writ petition is dismissed. However, liberty is given to the petitioners herein to submit representations to the respondent-organisation within a period of one month from the date of receipt of a copy of this order for reddressal of their grievance. If any such representations are submitted by the petitioners herein within the time stipulated above, the same shall be considered by the respondent-organisation and pass appropriate orders in accordance with law within a period of two months thereafter. No order as to costs. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed.
