DAVE Date : 15/02/2012 ORAL ORDER Heard learned advocate for the applicant and it is submitted that the issuance of order under Section 202 of the Code on 11.7.2011 in a private complaint, where the dispute is basically about date of birth recorded into service record of the applicant who was allowed to retire voluntarily and further so far as issuance of charge­sheet is concerned while admitting Special Civil Application No. 7063 of 2011 on 6.9.2011 interim relief is granted in terms of para 7(C) staying the operation and execution of the charge­sheet and conduct of the departmental inquiry.

In the above circumstances, a case is made out by issuing notice returnable on 14.3.2012.

Meanwhile, there shall be ad­interim relief in terms of para 7(B) till further order.
