ORDER:
This Writ Petition is filed for a Mandamus to declare the action of the respondents, in not allotting the essential commodities to the petitioner’s fair price shop No.24 of Kasturirajugaripalle, H/o Kurnoothala Village, L.R.Palle Mandal, YSR Kadapa District, as illegal and arbitrary.
At the hearing, learned Assistant Government Pleader for Civil Supplies (Andhra Pradesh), on instructions, submitted that the petitioner was appointed as a temporary fair price shop dealer following suspension of the permanent fair price shop dealer; that the proceedings initiated against the permanent fair price shop dealer were concluded; and that an order restoring his authorization was passed, vide Ref.No.C/4570/2012, dated 23.06.2014, on imposition of fine of Rs.5,000/- and with a warning to him. He has placed before the Court a copy of the said proceedings.
In view of restoration of the permanent fair price shop dealer, the petitioner’s temporary fair price shop dealership automatically comes to an end. Therefore, no Mandamus can be issued as sought for in this Writ Petition.
For the above-mentioned reasons, the Writ Petition is dismissed.
As a sequel to dismissal of the Writ Petition, W.P.M.P.No.50619 of 2014 filed by the petitioner for interim relief is dismissed as infructuous.
