ORDER:
This writ petition is filed for a mandamus to declare the action of the respondents in not releasing the essential commodities to the petitioner’s shop No.23 of Mogarala Village, Pakala Mandal, Chittoor District as illegal and arbitrary.
At the hearing, the learned Assistant Government Pleader for Civil Supplies (AP), on instructions, submitted that so far no proceedings under Section 6-A of the Essential Commodities Act, 19555 have been initiated and that the petitioner’s authorisation has not been suspended. He has further submitted that if the petitioner produces the demand draft before respondent No.4, essential commodities will be allotted in his favour.
In the light of the above submissions of the learned Assistant Government Pleader, the writ petition is disposed of by permitting the petitioner to approach respondent No.4 for receiving the allotment order. On receiving such allotment order, the petitioner shall submit demand draft to respondent No.4, who thereupon shall allot essential commodities to the petitioner.
As a sequel to disposal of the writ petition, W.P.M.P.No.50120 of 2014 shall stand disposed of as infructuous.
