Order:
This Writ Petition is filed for a Mandamus to set aside the Endorsement bearing R.C.No.323/2014/A, dated 31.10.2014, of respondent No.1, whereby he has seized the petitioner’s bore well along with the bore wells of six others.
A perusal of the impugned endorsement shows that, based on the report of the Mandal Revenue Inspector, Bukkapatnam, respondent No.1 has prima facie arrived at the conclusion that except the bore well dug in Survey No.87, as mentioned at serial No.8 therein, all other bore wells were dug in contravention of the Andhra Pradesh Water, Land and Trees Act, 2002, and that, therefore, they are seized.
In the light of the above facts, respondent No.1 is directed to hold a detailed enquiry wherein he shall give an opportunity of personal hearing to the petitioner and other similarly situated persons, pass a final order with detailed reasons and communicate the same to the petitioner within one month from the date of receipt of this order.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel, WPMP.No.43441 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
