M.Gaythri ...Respondent PRAYER: The Civil Revision Petition has been filed under Article 227 of the Constitution of India, to direct the Family Court, Salem to dispose of the petition in FCOP.No.79/2009 as expeditiously as possible.
For Petitioner : Mr.Sreesh For Mr.V.Raghavachari O R D E R According to the petitioner, the petitioner has filed a petition in FCOP.No.79 of 2009 for divorce before the Family Court, Salem. The aforesaid suit was filed in the year 2009. The evidence of petitioner has been concluded and posted for cross examination of the respondent witnesses. The above suit is pending for more than seven years. Therefore the present Civil Revision Petition has been filed for the above said relief.
2. On perusal of the 'A' Register extract, it has been indicated that both the parties were not present on the following dates i.e. 07.04.2017, 22.05.2017, 21.06.2017, 11.08.2017. But subsequently, the petitioner was present and posted for cross-examination of the respondent witness, RW2.
3. By taking into consideration of the facts and circumstances of the case and the suit is pending for the last seven years, it is appropriate for this Court to direct the Family Court, Salem to dispose of the said FCOP.No.79/2009 as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order.
4. The Civil Revision Petition is disposed of with above direction. No costs.
