The writ petition is filed for a Mandamus declaring the action of the respondents 2 and 3 in not allowing and not releasing essential commodities by receiving Demand Draft to the petitioner’s fair price shop No.9 of Kalluhola village, Bommanahal Mandal, Ananthapur District though the petitioner’s authorization is valid and subsisting and for a consequential direction to the respondents 2 and 3 to release the essential commodities to the petitioner’s fair price shop.

The case of the petitioner is that he was appointed as fair price shop dealer on temporary basis by the 2nd respondent vide proceedings dated 21-02-2004 and distributing essential commodities to the cardholders without any complaint. While so, though the petitioner is having valid and subsisting authorization being renewed up to 31-03-2016, the respondents are not receiving the Demand Drafts submitted by the petitioner for obtaining essential commodities. Aggrieved by the same, present writ petition is filed.
3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.

In this case, admittedly, as the petitioner was appointed as Fair Price Shop dealer of Shop No.9, Kalluhola village, Bommanahal Mandal, Ananthapur District, vide proceedings dated 11-02-2014, on temporary basis, he shall be continued as long as his authorisation is valid and subsisting or till the vacancy is filled up on regular basis.

In view of the above, the respondents are directed to supply the stocks to the petitioner as long as his authorisation is valid and subsisting or till the vacancy is filled up on regular basis, whichever is earlier. However, it is open for the respondents to take appropriate action in case the petitioner commits any violation.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
