Criminal Appeal No.779/2009 is filed under Section 378(4) of Cr.P.C., praying to set aside the judgment dated 09.06.2009, passed by the XXI Addl. C.M.M., Bengaluru, in C.C.No.2627/2003 – acquitting the respondents accused for the offences P/U/S 138 of N.I. Act.
These Appeals coming on for Orders, this day, the Court made the following:
ORDER Learned counsel for the parties submit that they would not press the joint memo filed on 22.11.2018, as such, the said memo is taken as not pressed.
2. Learned counsel for the respondents submits that he would not press the memo filed on 03.01.2019 reporting settlement of the matter.
3. In view of the above submission, the said memo filed on 03.01.2019 is also taken as not pressed.
4. Learned counsel for the appellant files a common memo dated 07.01.2019 in both the appeals, not pressing the appeals.
5. In view of the memo and supporting submission from both side, both the appeals stand dismissed as not pressed.
