HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.29312 of 2014 ORDER:
Land to an extent of 47180 square meters in Atkuru Village, Unguturu Mandal, Krishna District, was acquired for the purpose of widening of National Highway. Land of the petitioner to an extent of 213 square meters in Survey No.2/2A was also acquired. So far as the petitioner is concerned, Rs.12.33 lakhs was determined as compensation payable. Not satisfied with the said compensation, the petitioner filed arbitration application before the District Collector, Machilipatnam, Krishna District (1st respondent), dated 22.08.2014, which was sent on 06.09.2014, which might have been received much later. This writ petition is instituted alleging that the District Collector is not disposing of the arbitration application. As seen from Ex.P-3, only recently the arbitration application is filed. The District Collector cannot be expected to act on arbitration application within less than two (2) weeks.
2. If the application is received and it is pending, the District Collector, Machilipatnam, Krishna District (1st respondent) shall consider the same, in accordance with law, and pass appropriate orders within a period of three (3) months from the date of receipt of a copy of this order. Accordingly, W.P. is disposed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
