This Public Interest Litigation has been filed for an order, writ or direction or declaration that the action of the sixth respondent in effecting change of the name of A.P. Society for Knowledge Networks to Telangana Academy for Skill and Knowledge by way of amendment in the seventh respondent – Registrar of Societies, through Registration No.671/2004 (amendment) on 18.09.2014 without obtaining consent of the State of Andhra Pradesh as necessitated under Section 75 of the Andhra Pradesh Reorganization Act, 2014 (for short ‘the Act’) is illegal, arbitrary, mala fide and contrary to the provisions of the Act and also in violation of Article 14 of the Constitution of India.
It is not in dispute that the above institution mentioned in the prayer appears within Telangana Area. The grievance of the petitioner is, effecting change of the name of the institution is contrary to Section 75 of the Act which only ensures continuance of facilities in certain State institutions as mentioned in the Tenth Schedule of the Act. It is nowhere alleged that the said institution has discontinued the facilities to other State.
Under these circumstances, we are of the view that if change of the name takes place, there has been no violation of the provisions of the Act and it is only when the institution will stop rendering facilities to other State, as mentioned in Section 75 of the Act.
Therefore, this Public Interest Litigation is dismissed.
No order as to costs.
Consequently, pending miscellaneous petitions, if any, shall stand closed.
