COMMON ORDER:
These three Transfer Criminal Petitions are disposed of through this common order.
2. The petitioner in Tr. Crl. Petition No.98 of 2014 and Tr. Crl. Petition No.99 of 2014 is one and the same. He is the first petitioner in Tr. Crl. Petition No.100 of 2014. He is involved in four cases in C.C.No.554 of 2013 on the file of XVII Additional Metropolitan Magistrate, Hyderabad, C.C.No.1770 of 2013 on the file of XIV Additional Chief Metropolitan Magistrate, Hyderabad, C.C.No.749 of 2013 on the file of I Special Magistrate, Erramanzil, Hyderabad and C.C.No.344 of 2014 on the file of XI Metropolitan Magistrate, Cyberabad at L.B. Nagar.
3. The petitioner, who is the sole accused in C.C.No.749 of 2013 and C.C.No.1770 of 2013; and also first accused in C.C.No.554 of 2013, is said to be 70 years old.
4. The learned counsel for the petitioners seeks for transfer of the cases to the Court of XI Metropolitan Magistrate, Cyberabad at L.B. Nagar, where the trial in C.C.No.344 of 2014 is said to have commenced.
The de facto complainant in two of the cases is the same individual and the de facto complainant in another case is a firm.
5. I consider that where the accused is common albeit causes of action are entirely different in view of the age of the accused, it would be appropriate to transfer the cases to one court for disposal according to law.
6. Consequently, these three Transfer Criminal Petitions are allowed. C.C.No.554 of 2013 on the file of XVII Additional Metropolitan Magistrate, Hyderabad, C.C.No.1770 of 2013 on the of XIV Additional Chief Metropolitan Magistrate, Hyderabad and C.C.No.749 of 2013 on the file of I Special Magistrate, Erramanzil, Hyderabad are withdrawn and made over to the Court of XI Metropolitan Magistrate, Cyberabad at L.B. Nagar for disposal according to law.
7. Miscellaneous Petitions, if any pending in these Transfer Criminal Petitions shall stand closed.
