JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.9443 of 2014 Dated : 04.06.2014 Between:

THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.9443 of 2014 ORDER :
The petitioners averred that they are washer men by profession and are using the land to an extent of Ac.0.20 cents in Survey No.64/1- D2 situated at Vikasnagar, Pedagantyada Mandal, Visakhapatnam District for the purpose of washing and drying. They constructed water tank to preserve water apart from providing other resources like drilling of bore well. The said land is adjacent to the steel plant. But the same is not used by the steel plant and it is kept idle. Except the said land, the petitioners have no other alternative land. The petitioners’ association submitted a representation for permanent allocation of the land, which is being used by them. After considering the representation, the Tahsildar vide letter dated 11.07.2008 reported to the Collector, Visakhapatnam that he along with Mandal Surveyor inspected the land in question on 04.07.2008 and noticed that it is not being used by the steel plant. Even though the said land was originally belonged to the steel plant, the same has been utilising by the Rajakas of Vikashnagar for washing and drying the clothes. They have also dug a borewell. Therefore, he recommended the District Collector to consider the request of the petitioners.

Learned counsel for the petitioners submits that though the petitioners have been using the said piece of land to carry out their avocation, there has been a consistent threat of displacement by the intermediaries as well as some officials of the steel plant. He further submits that so far, no orders have been passed by the District Collector on the representation made by the petitioners’ association.
3. Having regard to the aforesaid submissions and having regard to the facts and circumstances of the case, without expressing any opinion on merits of the case, this Writ Petition is disposed of directing the District Collector, Visakhapatnam to consider the representation of petitioners’ association-Rajaka Seva Sangham, Bapuji Colony, which was forwarded by the Tahsildar vide his letter dated 11.07.2008, within a period of four weeks from the date of receipt of a copy of this order and communicate the same to the petitioners. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
