This writ petition is filed for a mandamus declaring the action of the respondents in not allotting essential commodities to the petitioner’s fair price Shop No.24 of Nagambotlapalem village, Tallur Mandal, Prakasam District as illegal and arbitrary and for a consequential direction to the respondents to allot essential commodities to the shope of the petitioner.
2. The case of the petitioner is that he was appointed as a fair price shop dealer of Shop No.24 of Nagambotlapalem village, Tallur Mandal, Prakasam District in the year 2011 and he has been distributing essential commodities regularly from the date of his appointment without any complaint. While so, on 08-09-2014, the shop of the petitioner was inspected and seized the available stock of rice under the cover of Panchanama with incorrect recitals and no notice was issued to the petitioner. It is further stated that though the authorisation of the petitioner is valid and subsisting, the respondents 3 and 4 are not supplied stocks to the petitioner for distributing the same to the cardholders. Aggrieved by the same, the present writ petition is filed.
3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.

Since it is stated that the authorisation of the petitioner’s fair price shop is valid and subsisting, the respondents 3 and 4 are directed to supply the stocks to the petitioner as long as his authorisation is valid and subsisting. However, this order will not preclude the 3rd respondent from taking appropriate action in case the petitioner has committed violation of Control Order, 2008.
Accordingly, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
