JUDGMENT: (per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta)
We have heard the learned counsel appearing for the parties. We have seen the impugned judgment and order of the learned trial Judge. The learned counsel for the appellant on instructions received from his client, argued that his client will shift his shop in Room No.39, bearing D.No.15/353, situated at Municipal Complex, in Ward No.16 of Guntakal Municipality, to another place in terms of the order, dated 19.08.2014, passed by the Prohibition and Excise Superintendent, within six weeks from the date of receipt of the copy of this order. In view of this, nothing remains in this appeal.
Therefore, the order of the Hon’ble trial Judge is modified to the extent indicated above. In the event, the appellant fails to shift his shop room in terms of the undertaking given before this Court, respondents 2 to 4 shall forthwith take action for his eviction in accordance with law.
The appeal is accordingly disposed of. It is open for the parties to approach the Hon’ble trial Judge to hear the matter and dispose of finally.
Pending miscellaneous petitions, if any, shall stand closed.
