Writ Petition No.12179 of 2014 is filed for the following substantive relief:
“to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus by declaring the Notice bearing No.52Q/24704, dated 13-03-2014, issued by the 2nd Respondent for setting sale proclamation against the property bearing No.8-4-370/570, Raj Nagar, Borabanda, Hyderabad - 500 018, which belongs to the 1st Petitioner, as illegal, arbitrary and violative of the principles of natural justice and consequently, to set aside the same.”
WPMP.No.42505 of 2014 is filed seeking permission of the Court to withdraw W.P.No.12179 of 2014 with liberty to M/s.Manasa S.C.Labour Contract Co-operative Society Limited to raise a dispute under Section 75 (1) (g) of the Employees’ State Insurance Act, 1948, before the Employees’ Insurance Court and the Chairman, Industrial Tribunal-I, Hyderabad.
In view of the above, WPMP.No.42505 of 2014 is allowed and W.P.No.12179 of 2014 is dismissed as withdrawn with liberty to the petitioners in terms of the prayer made.
As a sequel to dismissal of the Writ Petition, interim order, dated 22-04-2014, is vacated and WPMP.No.15324 of 2014, filed by the petitioners for interim relief, is disposed of.
